Right of Withdrawal at Dutch-smart
Under the Distance Selling Act, consumers who make purchases online are entitled to a 14-day “cooling-off period” following delivery of the product. Within this period, a product may be returned without giving a reason. Unfortunately, this does not apply to our fresh products such as magic mushrooms and truffles. Nor does it apply to our vaporizers/bongs and pipes (that have been used) or sex toys.
With us, you have the right to cancel your order up to 14 days after receipt without giving a reason. After cancellation, you have another 14 days to return your product.
You will then be credited the full order amount, including shipping costs. You are only responsible for the costs of returning the item from your home to the online store. These costs amount to approximately €6.95 per package; please consult your carrier’s website for exact rates.
If you exercise your right of withdrawal, the product must be returned to the merchant with all accessories provided and, if reasonably possible, in its original condition and packaging. If the product is damaged or the packaging is damaged beyond what is necessary to try the product, we may charge you for this reduction in the product’s value. Therefore, please handle the product with care and ensure it is properly packaged when returning it.
To exercise this right, please contact us atsupport@dutch-smart.nl. We will then refund the order amount within 7 days of receiving your return notification, provided the product has already been returned in good condition.
As long as your order has not yet been paid for, packed, and/or shipped, you can cancel the order by sending an email to support@www.dutch-smart.nl.
What is my warranty if my magic mushroom grow kit is damaged or does not work?
Please note that purchasing this product requires some skill and that the exact instructions must be followed. If you follow different instructions, we cannot guarantee the quality of the kits. Are you experiencing a problem with the grow kit? Please contact us within 6 to 8 weeks of purchase. The kits are a little piece of nature in a box; they don’t respond to deadlines and are all unique. It’s also important to know that the kits are not covered by the warranty during summer shipping. This is because temperatures above 25 degrees can cause problems with the mycelium. The kits can grow within a week, but it may take up to 5 weeks. Also, make sure to set up the kit immediately upon receipt. Always keep the packaging in which the grow kit was delivered; it contains the batch numbers we need for warranty purposes if the grow kit is damaged.
Always ensure you work with gloves, a face mask, and clean, fresh air and water when using these kits. We are not responsible for any infections present in the kit if a clean workspace was not used. The kits must never be touched with bare hands and must never be inhaled directly without a face mask. We only send replacements for kits if we determine that an incorrect batch was shipped from our laboratory. Please note that we will only send one replacement (or issue a refund) unless there was an issue with the batch or delivery.
After your order has been shipped
If you have received your order and wish to return it, please always send an email to support@www.dutch-smart.nl first.
You are only responsible for the return shipping costs. The total amount will be refunded to your bank account within 7 days once Dutch-Smart has received your return shipment. Please make sure to include your account number!
Please be aware that, regardless of the reason for cancellation, you must act within the legal time limit and therefore notify Dutch-Smart within 14 days of receiving your order, and subsequently return the item within 14 days
We have received a product returned for repair; what now?
Our experts will confirm receipt and investigate the issue.
- If repair is an option, we will proceed with it. We will test the product and send it back to you.
- If it is not possible to repair the product, we will send you a replacement. This is handled through our supplier and may take some time.
Please remember to contact our customer service first before returning the item.
We will reduce the refund amount if:
- Products have been damaged by the user or during transit back to us.
- Parts are missing.
- In the case of fresh products, such as our grow kits, that have not been handled according to instructions.
- If you refuse your order or do not clearly indicate that you wish to exercise your right of withdrawal within the agreed period, it is impossible for Dutch-Smart to determine why you did not accept your order. In such cases, you will not only be charged for your order but also for all additional costs that Dutch-Smart incurs in connection with the transaction. Please be aware that you are required by law and/or regulations to actively inform us of your intention to return products within the agreed period.
Exceptions
- Products made according to the customer’s specifications
This category includes products that are truly manufactured specifically according to the customer’s specifications. Specific requirements apply here. A product with, for example, 6 fixed options that is only assembled after the order is placed generally does NOT fall under this category. A standard sofa set with a choice of upholstery may therefore not be excluded from this rule under the law. A computer that is custom-built using standard components also does NOT fall under this category. A necklace engraved with the buyer’s name does, however, or a cabinet that has been specially designed and made for the consumer. The way the product is presented is key here. If a product displays various options via a dropdown menu, this is generally considered standard. If you can manually specify measurements and customizations down to the centimeter, it is quickly considered custom-made. - Hygiene products or products posing a health risk, and those whose seal has been broken
Products that cannot be returned after opening due to hygiene or health risks may be excluded from the right of withdrawal. However, these products must be sealed. If the seal is unbroken, the products may be returned as usual. The right of withdrawal only expires after the seal has been broken. Examples of such products include a jar of spices or a baby pacifier.
